NIO wins trademark lawsuit in Australia, Audi's objection is rejected

According to the latest reports, public information from JADE, an Australian judicial document website, shows that NIO's "ES6, ES7, ES8" trademark registration application in Australia was supported by the Australian Intellectual Property Office, and Audi's objection request was rejected. This battle over the "ES" car name trademark began in 2021, when Audi claimed that NIO's ES6 and ES8 infringed on the trademark rights of its S6 and S8. Although Audi won the lawsuit in Germany and banned NIO from using the ES model name, NIO has changed its ES naming sequence in Germany to EL starting from 2022 and is not affected by the judgment. This time, Intellectual Property Australia determined that NIO’s trademark is significantly different from Audi’s trademark and does not constitute a substantial similarity.
